ABOUT THE BILL

Bans the manufacture and provision of abortion-inducing drugs in Oklahoma and empowers private citizens to enforce the law through qui tam actions.

OUR POSITION

Chemical abortions now account for the majority of abortions performed in the United States. As surgical abortion access has been restricted in Oklahoma and states like it, abortion providers and advocacy organizations have increasingly turned to mail-order distribution of abortion-inducing drugs as an alternative pathway. This bill addresses that gap directly by prohibiting the manufacture and provision of such drugs within the state.

The qui tam enforcement mechanism included in this bill is a significant and practical feature. By authorizing private citizens to bring legal actions against violators, the bill does not rely solely on government prosecutors to pursue enforcement. This model has proven effective in other contexts and substantially raises the likelihood that the law will deter violations in the real world rather than exist only on paper.

From a principled standpoint rooted in our faith, every human life is formed in the image of God and possesses inherent dignity from the moment of conception. The state bears a legitimate and serious responsibility to protect those who cannot protect themselves. Legislation that closes enforcement gaps and extends protection to the unborn at every stage is consistent with that responsibility.

Oklahoma has already built a substantial legal framework aimed at protecting unborn life. This bill strengthens that framework by confronting a method of abortion that has grown precisely because it is harder to regulate and easier to obscure. Addressing chemical abortion specifically is not a peripheral concern but a central one given current trends in how abortions are carried out.

The American Council supports SB1657. It is a serious and enforceable measure that reflects both sound legal craftsmanship and a genuine commitment to protecting human life. We encourage the legislature to advance it promptly.
