Homeschool Parent's Bill of Rights

The American Council urges New Jersey legislators to pass A231, the Homeschool Parent's Bill of Rights. This legislation would affirm in statute that the homeschool parent or guardian holds a fundamental right to direct their child's education, and that nothing shall infringe upon that right. Codifying that principle is not a bureaucratic formality -- it is a meaningful legal shield for families who have chosen to take direct responsibility for their children's formation.

A231 would establish a clear set of enumerated rights for homeschooling families in New Jersey. Parents would be granted the right to provide an individualized education based on their child's strengths and weaknesses, to choose who will teach their child, and to maintain sole authority over the curriculum while allowing their child to explore subjects of genuine interest. These are not privileges granted by the state; they are parental responsibilities that the state should recognize and protect.

The bill would also affirm the right of parents to provide a nurturing and safe educational environment in whatever manner they believe is appropriate, and to set the pace and approach of instruction solely as they determine best serves their child. We at the American Council believe that those closest to a child -- above all, the parents -- are best positioned to make these judgments. A231 would give that conviction the force of law.

Critically, A231 supplements existing New Jersey education law without amending or repealing any current provision. It adds a positive declaration of rights rather than dismantling existing structures. This is a measured, principled step that respects the diversity of educational choices families make while ensuring that homeschooling parents are not left without a clear statutory foundation for the rights they already exercise.
