ABOUT THE BILL

Bars the most serious child sex offenders from loitering within 1,000 feet of schools, churches, and other places children gather without a legitimate purpose.

OUR POSITION

New Hampshire Senate Bill 460 prohibits Tier III registered sex offenders whose victims were children under age 13 from being present in designated child safety zones under alarm-warranting circumstances without a legitimate purpose. These zones include schools, playgrounds, childcare facilities, and houses of worship. The bill passed one chamber and now awaits final action.

The protection of children from those who have already demonstrated a willingness to cause them grievous harm is not a political question. It is a moral one. Scripture calls communities to defend the vulnerable and the innocent, and civil law is a proper instrument for fulfilling that duty. This bill is a straightforward exercise of that responsibility.

The bill is carefully scoped. It applies only to Tier III offenders, the most serious classification, whose offenses involved the youngest victims. This precision strengthens the law's constitutional standing while ensuring enforcement resources are directed where the danger is most documented and most acute.

The inclusion of churches among protected zones is meaningful. Houses of worship are places where families bring children expecting safety and spiritual formation. Affirming that expectation in law honors both the sanctity of those spaces and the trust families place in them.

The 'alarm-warranting circumstances' legal threshold prevents overbreadth and protects against arbitrary enforcement. It is a reasonable and well-established standard that keeps the law enforceable, targeted, and fair while preserving its protective purpose for children and families across New Hampshire.
