The order itself is brief and contains a single operative provision: "That the committee on The Judiciary be authorized and directed to make an investigation and study of certain current Senate document numbered 1579 relative to eliminate barriers and expand abortion access for patients under the age of 16." The order does not itself amend any statute, appropriate any funds, remove any existing protection, set any deadline for reporting back, or require the committee to make any recommendation. It confers no authority on the committee to advance S1579 toward enactment.
We want to be precise about what this order is and what it is not, because the distinction matters for our argument. S2984 is the disposition the joint committee on the Judiciary chose to report in place of S1579 itself. It authorizes a study; it does not place S1579 on a path to a floor vote, and defeating S2984 would not, as a direct legal matter, prevent S1579 from being taken up by other means. We oppose S2984 on its own terms: investing formal legislative authority in an investigation of a proposal whose stated purpose is to eliminate barriers to abortion access for minors under 16 is itself a step we believe Massachusetts should not take. Young people under 16 deserve more protection, not a legislature formally engaged in studying how to remove the guardrails that exist for their benefit. The American Council believes that authorizing any official study of S1579 lends institutional weight to a direction that is harmful to vulnerable minors, and we urge the defeat of this order on that ground.
